Business Talent Visa Subclass 132: What this Business Talent visa lets you do

The Business Talent visa (subclass 132) allows you to establish a new or develop an existing business in Australia.

This is a permanent residence visa. It lets you and any family members who have also been granted this visa:

  • stay in Australia indefinitely
  • work and study in Australia
  • enroll in Medicare, Australia’s scheme for health-related care and expenses
  • apply for Australian citizenship (if you are eligible)
  • sponsor  eligible relatives for permanent residence
  • travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return  visa or another visa to return to Australia).

Business Talent Visa Subclass 132: Before you apply

To be able to apply for this visa, you must first submit  an Expression of Interest (EOI)  and then be invited through Skill Select to apply.

Your expression of interest must specify:

  • which stream you intend to apply under
  • whether you are interested in doing business in just one or more  Australian states and territories.

When you have submitted  your expression of interest, a state or territory government could examine it and decide whether to nominate you to apply for the  visa. State and territory authorities have their own criteria for deciding who to nominate. The authority might contact you before you are nominated to discuss business possibilities. In others, the authority will wait for you to contact it.

If you receive an invitation, you will have 60 days to apply online for the visa. During that time, you cannot change the information in your expression of interest. If you receive two invitations to apply for a visa and you do not lodge an application, your expression of interest will be removed from SkillSelect. If you still want to apply for a visa, you will need to lodge a new expression of interest.

Although you do not need to provide supporting documents with an expression of interest, your visa application is likely to need extensive supporting documentation, as listed in the document checklist. Start compiling your documents early in the process, so you can respond within the 60 days if you  receive an invitation.

Your passport

You need a valid passport or other travel document for this visa. If you plan to get a new passport, you should do so before applying for your visa. If you get a new passport after you have lodged your application, give the details of your new passport to one of  the department of immigration and border protection offices.

Business Talent Visa Subclass 132: No further stay condition

You cannot apply for this Business Talent visa if you already hold another visa that has a ‘No further stay’ condition.

Business Talent Visa Subclass 132: Who could get this visa

You might be able to get this Business Talent visa if:

  • you are nominated by a state or territory government
  • you are invited to apply
  • you and your family members (whether or not they are included in your application)  meet health and character requirements
  • you meet the additional requirements for the stream in which you apply.

Business Talent Visa Subclass 132: Health requirements

You must meet certain  health requirements. The results are usually valid for 12 months.

This also applies to all members of your family unit included in your application, whether they are migrating or not.

Business Talent Visa Subclass 132: Character requirements

You must meet certain  character requirements. You must be prepared to provide a police certificate from each country you have lived in for 12 months or more during the past 10 years after you turned 16 years of age. Do not arrange for police certificates until the department of immigration and border protection ask you to.

This applies to you and all members of your family unit listed in your application, whether they are migrating or not.

Business Talent Visa Subclass 132: Debts to the Australian Government

You must have no outstanding debts to the Australian Government or have arranged to repay any outstanding debts to the Australian Government before this Business Talent visa can be granted.

Business Talent Visa Subclass 132: Significant Business History stream

You, your partner, or you and your partner combined must have all of the following:

  • total net assets of at least AUD400 000 as the ownership interest in one or more qualifying businesses for least two of the four fiscal years immediately before you are invited to apply and if the  qualifying business(es) was a publicly listed company, a shareholding  of at least 10 per cent of the total issued capital
  • net business and personal assets of at least AUD1.5 million that are legally acquired and can be transferred to Australia within two years after the visa is granted
  • a total annual turnover of at least AUD3 million in one or more of your main businesses in at least two of the four fiscal years immediately before you are invited to apply
  • ownership of at least:

o       51 per cent of a business with turnover of less than AUD400 000 per year

o       30 per cent of a business with turnover of more than AUD400 000 per year, or

o       10 per cent of a publicly listed company

  • an overall successful business career
  • no involvement in unacceptable business activities
  • a genuine desire to own and maintain a management role in a business in Australia.

You must also be younger than 55 years of age, although a state or territory can waive this requirement if your proposed business will be of exceptional economic benefit to the region where it will operate.

Business Talent Visa Subclass 132: Venture Capital Entrepreneur stream

You must have received at least AUD1 million in funding from an Australian venture capital firm.

The funding must be for the start-up, product commercialisation or business development of a promising high-value business idea.

The venture capital firm must be a member of the Australian Private Equity and Venture Capital Association Limited (AVCAL). AVCAL has information about the venture capital category of membership in its  Venture Capital entrepreneur visa factsheet.

You must have entered into a formal agreement with the venture capital firm for the funding.

Business Talent Visa Subclass 132: Including family in your application

You can include the following people in your visa application at the time of lodgement:

  • your partner
  • your child/step-child or your partner’s child/step-child.

This information explains what you need to do to apply for a Business Talent visa (subclass 132).

Lodge your application online

Pay the visa application charge by credit card when you apply. You must also send your documents as soon as you lodge your online application.

  • If you hold a passport of the People’s Republic of China (PRC), Hong Kong, Macau or Taiwan: send the documents to the Australian Consulate General in Hong Kong.
  • If you hold any other passport: send your documents by registered post to the Adelaide office  in South Australia – attention the Adelaide Business Skills Processing Centre.

After you have lodged your application and documents, the department of immigration and border protection will acknowledge  that they have received your information.

Wait for a decision

We have  visa processing times  for each visa.

Your application could take longer if you need character or health checks (including x-rays), if you need to provide more information, or if your application is incomplete.

Outside Australia: If you apply for this Business Talent visa from outside Australia, do not make arrangements to travel to Australia until you are advised in writing that you have been granted a visa. Wait for a decision from the department of immigration and border protection before you leave your job, sell your home or book your travel.

In Australia: If you apply for this Business Talent visa in Australia, you could be eligible for a Bridging visa that allows you to stay in the country lawfully while your application is processed. If you are given a Bridging visa A, you can apply for a  Bridging visa B (BVB)  to travel outside Australia while you wait for a decision.

Report changes in your circumstances

You must tell the department of immigration and border protection if your circumstances change. This includes a new residential address, a new passport, or a pregnancy, birth, divorce, separation, marriage, de facto relationship or death in your family.

Withdrawing your application

​You can withdraw the application at any time before the department of immigration and border protection make a decision about it. To do this, send them a letter or email to ask for the withdrawal. Your request must include your full name and date of birth. You should also include your file reference number, client ID, or a Transaction Reference Number.

​​​All applicants 18 years of age or older, wishing to withdraw, must sign the request for withdrawal.​​​​​​

If the visa is granted, the department of immigration and border protection will let you know:

  • when you can use the visa
  • the visa grant number
  • any conditions attached to the visa.​

If the visa is not granted, the department of immigration and border protection will let you know:

  • why the visa was refused
  • your review rights (if any). Where applicable, your sponsor can apply for the decision to be reviewed
  • the time limit for lodging an  appeal.

You might qualify for a  Special Benefit  from Centrelink if you suffer a major change of circumstances that is beyond your control.

Business Talent Visa Subclass 132: Your obligations

You and your family must comply with all visa conditions and Australian laws. You must fulfil your business obligations.

If you are outside Australia when the visa is granted, you must enter Australia by a specified date. The department of immigration and border protection will tell you what this is. Your family members might not be allowed to marry or enter into a de facto relationship before they enter Australia. The department of immigration and border protection will tell you if this condition applies.

You must tell the department of immigration and border protection your residential address within six months of arriving in Australia. Every time you change address (even to somewhere outside Australia), you must send a new form to them within 28 days of the move:

Business Talent Visa Subclass 132: Significant Business History stream

After entering Australia, you must:

  • establish a qualifying business in Australia, or
  • participate in an existing qualifying business in Australia.

In the business, you must:

  • maintain substantial ownership
  • maintain direct and continuous involvement in the day-to-day management of the business
  • make decisions that affect the overall direction and performance of the business in a way that benefits the Australian economy.

After becoming involved in business in Australia, you will be asked to complete:

Business Talent Visa Subclass 132: Venture Capital Entrepreneur stream

You must:

  • meet the requirements of your venture capital agreement after you enter Australia
  • have a genuine and realistic commitment to continuously maintain an ownership interest and engagement in your business and/or investment.
